UPTET primary teachers vacancy – Overage/Underage Court Case Status

Without taking care of High Court, Basic Shiksha Parishad have already published the ranking list on 22/01/2013; There is no overage/underage candidate in the list and those candidates who applied for this recruitment (overage/underage) are rejected now .

What is the matter ?

Actually, the same advertisement (72,825 primary teachers) was notified on 30/11/2011 and at that time, the age limitation was from 18 to 40 years . But due to some reasons it was cancelled and re-advertised on 05/12/2012 and this time the age limitation was fixed from 21 to 40 years .

As the gap was of more than one year, so come candidates got out due to age limitation conditions, some due to underage (below 21) and some due to overage (40+), now as they were eligible in 2011 so they want to be in the recruitment process now .

So they filed a case against UP government, and Allahabad High Court ordered that they should be allowed to apply for this recruitment, a last date to apply, was suggested by high court 24/01/2013 .

But as we know, Basic Shiksha Parishad have already published the merit list, so petition was filed  by these candidates yesterday .

The next hearing will be on Thursday .

Ok..Guys, the next date is 28/01/2013 .मामले में न्यायमूर्ति अरुण टंडन ने राज्य सरकार से बृहस्पतिवार को इस पर अपना पक्ष रखने को कहा था। स्थायी अधिवक्ता ने जवाब दाखिल करने के लिए और समय की मांग की। इस पर कोर्ट ने उनको सोमवार तक की मोहलत दी है।

In such circumstances, this Court has no other option but to direct that the applications of the petitioners-applicants may be filed on or before 31st January, 2013. For the purpose respondent no.1 shall ensure that today itself directions are issued for the Website being reopened for acceptance of the fresh applications. This order will govern all the petitioners whose writ petitions were disposed of in terms of the order dated 16th January, 2013 passed in Civil Misc. Writ Petition No.65811 of 2012 (Ashish Mishra vs. State of U.P. & others)
